In accordance with the provisions of the Planning Act, as amended, this Notice is to advise that the Township of Cavan Monaghan Planning Department received a complete application for a Zoning By-law Amendment. The Application applies to an existing lot of record known municipally as 347 Sharpe Line in Part of Lot 5, Concession 10 (Cavan).

The Zoning By-law Amendment is required to permit the construction of a detached accessory apartment in an accessory agricultural building located within the residential cluster on the subject property.

Subject Lands

The lands subject to the Zoning By-law Amendment are approximately 40.5 hectares (100 acres) in size with approximately 510 metres (1,700 feet) of frontage on Sharpe Line. The property is currently developed with a single detached dwelling approximately 743 square metres (4,688 square feet) in size. The house is serviced with private well and septic systems.

Purpose and Effect of Zoning By-law Amendment Application

The lands subject to the Application are currently zoned Agricultural (A) and Natural Linkage (NL) as shown on Map C-1 to By-law No. 2018-58, as amended. A single detached dwelling and an accessory apartment within the main dwelling are permitted in the A Zone. The accessory apartment is limited to 45% of the gross floor area of the main building.

The purpose of the Zoning By-law Amendment is to rezone a portion of the subject lands from the Agricultural (A) Zone to the Agricultural Exception Nineteen (A-19) Zone to permit the construction of a detached accessory apartment approximately 185 square metres (2000 square feet) in size that will be attached to a 185 square metre (2000 square foot) accessory agricultural building located within the residential cluster. For the purpose of this By-law, the residential cluster shall be defined as approximately 65 metres (213 feet) from the principal dwelling. The accessory apartment will be limited to 45% of the floor area of the principal dwelling.

Public Meeting

Township Council will hold a Public Meeting in accordance with Section 34 of the Planning Act, R.S.O. 1990, as amended for the Zoning By-law Amendment application ZBA-09-24 (Travers) as follows:

Time: 1:00 p.m.

The purpose of the Public Meeting is to provide more information about the Application and provide an opportunity for public input.

To Speak at the Public Meeting or Provide Written Comments

Any person may attend the public meeting and make written and/or verbal representation either in support of or in opposition to the proposed Amendment. If you are unable to attend the meeting, written submissions may be submitted and should include a request for further notice, if desired. Written submissions must be received by the Clerk’s Office no later than 9 a.m. on March 3rd, 2025.

Right to Appeal

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Cavan Monaghan in respect of the Zoning By-law Amendment before Council approves or refuses to approve the Amendment, the person or public body is not entitled to appeal the decision of the Township to the Ontario Land Tribunal.

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Cavan Monaghan before the Council approves or refuses to approve the Amendment, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
