In 2015, the Township of Cavan Monaghan Official Plan was approved, establishing a new planning framework that implements current provincial policy and recent amendments to the County of Peterborough Official Plan.  The new Official Plan addresses contemporary planning issues such as economic development, revitalization, heritage conservation, and sustainable building design. The Official Plan is a comprehensive policy document that affects all land within the Township and provides a vision for future growth.

In accordance with Section 26(9) of the Planning Act, there is now a need for the Township to complete a review of its Zoning By-law, to ensure that it conforms to the policies of the new Official Plan.  This is also an opportunity to consider implementing contemporary zoning tools and address local issues.  The Township's existing Zoning By-law No. 2004-62 was approved in 2004 and since then, there have been several amendments.

What is a Zoning By-law

A Zoning By-law is a legal document required by the Planning Act, which is used by the Township to control the use of land.  A Citizen's Guide to Zoning (prepared by the Ministry of Municipal Affairs and Housing) is a document that provides further explanation.  Essentially, regulations in the Zoning By-law, state precisely:  

  • The uses and buildings that may be permitted on a lot 
  • Where buildings or structures may be located on a lot
  • The required size and dimensions of a lot; and
  • Building heights, parking requirements, and setbacks that must be met.

The Township's Zoning By-law is intended to manage future development and protect property owners from conflicting land uses.

Zoning By-law or Official Plan, What's the Difference?

An Official Plan sets out a community vision and goals for the future. It ensures that new development and growth considers a broad range of interests and perspectives and that land use planning decisions are made to reflect local values. If you are interested in long term growth forecasts, future development patterns, and strategies for protecting resources, an Official Plan is the document you should consult.

On the other hand, a Zoning By-law establishes regulations that help implement the policy directions set out in the Official Plan. If you are interested in finding out about the permitted uses or parking requirements for your property, or regulations for operating a home business, the Zoning By-law will provide detailed information.
