Notice of Adoption of a Community Improvement Plan

Take Notice that Council of the Township of Cavan Monaghan passed By-law No. 2018-51 to designate a Community Improvement Project Area and By-law No. 2018-52 a by-law to adopt the Millbrook Community Improvement Plan (MCIP) on September 4, 2018 under Section 28 of the Planning Act, R.S.O. 1990, c.P. 13, as amended. In making its decision to pass the By-laws, Council considered all written and oral submissions made to Council.

And Take Notice that any individual, corporation or public body may appeal to the Local Planning Appeal Tribunal (LPAT) in respect of the By-law by filing a notice of appeal that sets out the reasons for the appeal and the specific part of the By-law to which the appeal applies. Appellants must use Appellant Form A1 available from the LPAT website at http://elto.gov.on.ca/tribunals/lpat/forms/appellant-applicant-forms/.  A notice of appeal must be accompanied by a fee of $300.00 by certified cheque or money order made payable to the Minister of Finance. The appeal must be filed with the Township Clerk, Township of Cavan Monaghan, 988 County Road 10, Millbrook, ON L0A 1G0 on or before October 12, 2018.

Only individuals, corporations or public bodies may appeal a decision of the municipality to the LPAT. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the By-law was adopted, the person or public body made oral submissions at a public meeting or written submissions to Council or, in the opinion of the LPAT, there are reasonable grounds to add the person or public body as a party.

Amendments to this CIP will be passed by Council in accordance with Section 17 of the Planning Act. The Township of Cavan Monaghan will also be required to pre-consult with the Ministry of Municipal Affairs and Housing on any amendments to this CIP.

The Purpose and Effect of By-law No. 2018-52

The CIP establishes a toolbox of financial and non-financial incentives intended to improve the built environment, heritage attributes and resources, the diversity of uses; economic activity, housing choices and affordability, the public realm, views and streetscapes, walkability, trails and open spaces; and parking.  

Additional Information relating to the CIP is now available for inspection during normal office hours at the Township Planning Division in the Municipal Office at 988 County Road 10 or on the Township website www.cavanmonaghan.net .
